Resumo

A partir da historicidade do homem como ser social e cultural, se procura estabelecer o entendimento do crime como prática social e cultural. O texto se apropria de definições e paradigmas do Crime e da Pena e da Evolução da Pena quando utilizados como pretexto de higienização social pela via da exclusão da pessoa humana sob os interesses dos sistemas de poder, através da vigilância e controle social. A adoção da repressão através da pretensão de justiça e instituições de modelagem social como mecanismos de reprodução de poder. A vítima como justificativa penal. Indivíduos denominados "criminosos". A classificação etiológica e o crime como prática social não individual.

Abstract: Starting from the history of man as social and cultural being, try to establish the understanding of the crime as a social and cultural practice.
