O Acesso a Justiça e a Arbritragem

Resumo

Como é de conhecimento público, a morosidade da justiça, acaba por afastar do processo a esmagadora maioria da população. Com poucos juízes e uma estrutura incapaz de vencer a demanda, o acesso a justiça passou a ser privilégio de poucos. É neste contexto que são bem vindos os meios alternativos de resolução conflitos, entre os quais a arbitragem. Antes mesmo de se pensar em juízes ou tribunais, já se praticava a arbitragem. O instituto da arbitragem estende suas raízes até a Babilônia de 3.000 anos a.C., na Grécia Antiga e em Roma. No Brasil, a arbitragem integra o ordenamento jurídico desde a Constituição Imperial de 1824, mas com a aprovação da Lei 9.307, de 23 de setembro de 1996, adquiriu melhores condições para sua efetiva aplicação. É crescente o número de profissionais e entidades que vêm se dedicando à arbitragem no Brasil. Trata-se de uma espécie autônoma no mundo do direito e pode ser aplicada com grande eficiência na solução de conflitos no âmbito dos direitos patrimoniais disponíveis. Deve ser vista também, como uma forma de participação popular na tarefas do Poder Judiciário, pois a medida que absorve parte da demanda, desafoga os fóruns e tribunais e contribui para a celeridade da justiça.

Abstract: The moroseness of judice, as it is to public knowledge, achiened intemoving from the process of the crushed majority of the population. With few judges and a structure that is unable to meet the demands and the, access to law has become the priviledge of so litle. It is in this context that, alternative means of conflict resolutions, are welcome among which the arbitration. The institute of arbitration extends its roots to Babylon of 3.000 gears b.C., old Greece and Rome. In Brazil, the arbitration integrates the judicial law since Emperial Constitution of 1824, also with the approval of law 9.307, of 23 rd September 1996 acquired better conatitions for its effective practise. The number of professionals and entities are increasing to arbitration in Brazil. Treat of an autonomous gender in world of right and can be applied with great efficiency in solution of conflicts in ambit of available patrimonial lanes. This should also be seen as a way of public participation in law suits of judicial government, since the measure that absolves part of the demand, disburdens the foruns and tribunals and contribute to a celerity of judice.
